Chinese Boy Challenges School Segregation
A suit at law has been brought in the United States District Court, in San Francisco, that will test the constitutionality of a California State law. The suit is in behalf of Henry Wing Him, a Chinese boy aged 11 years, who has been denied admission to a white public school. The action is against the principal of one of the grammar schools and the board of education, to restrain them from preventing his attending the school. His counsel alleges that Section 1662 of the Political Code, which provides that separate schools shall be established for Mongolian and Chinese children, is in conflict with the fourteenth amendment of the Federal Constitution. A final decision of this case is of widespread interest, as it concerns the principle of separate schools for white and colored children, throughout the country.
