Unincorporated Organizations Cannot Receive Bequests

In a recent decision by Judge Canty, of the Supreme Court of Minnesota, he holds that the Salvation Army or other unincorporated organizations, in order to take advantage of bequests left them must be incorporated; otherwise they can not receive a bequest, no matter on what terms the property may be left them. Incorporation is required that the beneficiary of the trust may be certain, or capable of being rendered certain, or, in other words, so that the courts may be sure that the property bequeathed goes to the use and enjoyment of the association for which it was intended.
